Full Version: Service Charge, Is It Separate From An Actual Restaurants Income?

This is a debate I am having in another forum...basically the story goes that a restaurant is under receivership by an administrator, whether court appointed or private is unknown.

They have seized the gratuities that were bequeathed to the staff by paying customers and said that tips are illegal and yet they are using them for their own ends.

What I am arguing is that it matters not if a company is in receivership, all gifts to a certain group of people are to be given to that group, not taken and handed over to someone else.

If an administration working for someone unknown states that tips are illegal shouldn't they pay them back if so and not keep them?

What are your thoughts on this, can a restaurant business seize gratuities that were meant for the workers?

I'm pretty sure they're not. The minimum wage for waiters is lower because of tips. If the restaurant is seizing gratuities, they have to bump the wages of their servers accordingly.

Tips aren't illegal; paying your employees under minimum wage is. As long as the waiters/waitresses report the earnings, it's perfectly legal and good manners to boot to give them tips. The company is just being a spiteful dipshizzle.
