Woman sues Bieber over hearing loss

A US woman has filed a $US9.2 million ($A9.1 million) lawsuit against pop star Justin Bieber, saying she suffered permanent hearing loss at his Portland, Oregon concert two years ago.

 

Stacey Wilson Betts filed the suit on Wednesday in US District Court. It says the mother of five sustained the injury after Bieber climbed into a heart-shaped gondola and was pulled over the crowd.

 

The lawsuit alleges Bieber enticed the fans into a "frenzy of screams" by waving his arms, and the sound exceeded safe decibel levels.

 

The gondola "acted as a sound conductor, creating a sound blast that permanently damaged both my ears," the lawsuit says.

 

Betts, who attended the concert with one of her daughters, is seeking money for medical expenses, pain and suffering and loss of quality of life.

 

The lawsuit lists Bieber as a defendant, as well as Island Def Jam Records and Vulcan Sports and Entertainment, which owns the arena in which the July 2010 concert took place.

 

Betts and the record label did not immediately return phone calls seeking comment. No lawyer is listed in the court documents.

 

The lawsuit says Betts has been seeing ear specialists because of hearing loss; severe tinnitus, or noise or ringing in the ears; and hyperacusis, a sensitivity to sound.

While I hope she does win, she probably won't cause going to the concert was on her own free will, assumed risk, etc, etc.

 

 

I dunno why she would sue the records label, it's not like they had any part in the thing. They just publish his music.

Even though she probably won't win, I can see how being in a crowd of screaming teenage girls can harm your ears. If the same thing happened to me at a Justin Bieber concert, I'd be pretty mad at Justic Bieber too, but in the end it would still be my fault for being there. When you go to bubble gum pop concerts, you should expect screaming.

My question: Why go to his concerts in the first place? Most of his fans are teenage girls... who scream a lot.

 

It says in the article that she went with her daughter.

The case will probably get thrown out, as there's probably something in the terms and conditions about stuff like that. You'd at least think that the event runners or whatever would cover their asses with something like that.

I assume it was at the Rose Quarter which is basically the largest concert hall we have. Does this person live in a cave? Has she never been to a stadium sized concert before? . It's called ear protection? Earplugs plain and simple. I don't even attend basement shows without earplugs.

The only thing that I'm curious about is if there is some sort of clause that eliminates his responsibility.... or the venue's responsibility.

 

I've never been to a concert where I've had to sign anything saying that the venue or artist won't be at fault for damages. I honestly feel like she could win this.

There might be something in the online ticket buying thing, like 'so and so are not responsible for any loss of hearing, you're responsible for your own safety, blah blah blah'.

I've never been to a concert where I've had to sign anything...

 

You wouldn't. Stuff like that is printed in microscopic lettering on the back of the ticket. It's called an "implied contract": using the ticket implies you agree to the contract. Next time you go to a concert, read the back of the ticket...

And I actually did just read the back of a ticket for a concert I'm going to in a month.

 

"Holder of this ticket voluntarily assumes all risks and danger incidental to the event for which this ticket is issued whether occurring prior to, during or after same and agrees that the organization, agents, participants, players, or MetroTix are not responsible or liable for any injuries resulting from such causes."

 

And I would bet that all tickets have this.

I never heard Bieber sing, so I'm not sure what style of music he does. But I have a hunch all the screaming girls would drown him out anyway, lol.

 

Well he certainly doesn't do anything close to rock. Could have just Googled it too.

I think I actually rather hear girls scream than Justin Bieber sing.
